Terms of service
Effective date: 1 June 2026
1. Agreement
These Terms of Service ("Terms") form a binding agreement between you and Pureheart Moluno ("we", "us", or "our"), the developer and operator of Vernac. By downloading, installing, or using the Vernac application or any related services, you agree to these Terms. If you do not agree, do not use Vernac.
We may update these Terms from time to time. Continued use of Vernac after any changes take effect constitutes your acceptance of the revised Terms. We will give you at least 14 days notice of material changes via in-app notification or email.
2. Eligibility
You must be at least 13 years old to use Vernac (or at least 16 if you reside in the European Economic Area). By creating an account, you confirm that you meet this requirement. Certain content categories (mature language and relationship vocabulary) are restricted to users aged 18 or older, verified by an in-app gate.
3. Your account
You are responsible for keeping your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at contact@pmoluno.com if you believe your account has been compromised.
Guest accounts are available with limited functionality. Data from a guest account will be lost if you uninstall the app before creating a full account. We are not responsible for data loss from guest sessions.
We reserve the right to suspend or terminate accounts that violate these Terms or that are used for fraudulent or abusive purposes.
4. Free tier and subscriptions
4.1 Free tier
Vernac is free to download and includes a limited set of features at no charge, including a daily word allowance, basic practice modes, and community features. Free tier users may see advertisements between sessions.
4.2 Vernac Pro
Vernac Pro is a paid subscription that unlocks unlimited words, all practice modes, AI-personalised content, widgets, wallpapers, ad-free experience, and other premium features as described in the app. Subscription plans include:
- Monthly: billed every 30 days.
- Annual: billed once per year. Includes a free trial period as stated in the app at the time of purchase.
- Lifetime: a one-time purchase granting lifetime access to Vernac Pro features available at the time of purchase.
4.3 Free trials
Free trials are available on eligible plans as stated in the app. Your subscription will automatically begin at the end of the trial period unless you cancel before the trial expires. You will be notified before the trial ends if you opt in to billing reminders (on by default).
4.4 Billing and cancellation
Subscriptions are billed through the Apple App Store or Google Play Store. Payments are processed by Apple or Google — we do not handle your payment card details directly. To cancel, manage your subscription through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you retain Pro access until then. We do not offer refunds except where required by applicable law or App Store/Google Play refund policies.
4.5 Consumable purchases
Streak freezes and word packs are consumable in-app purchases. Once used, they cannot be refunded or transferred.
4.6 Price changes
We may change subscription prices. If we increase the price of your current plan, we will give you at least 30 days notice and your existing subscription will continue at the old price until your next renewal, at which point you may choose to continue at the new price or cancel.
5. Acceptable use
You agree not to:
- Use Vernac for any unlawful purpose or in violation of any applicable law.
- Reverse engineer, decompile, or attempt to extract source code from the app.
- Circumvent any access controls, subscription checks, or security measures.
- Submit false, misleading, or harmful content to community features.
- Harass, threaten, or abuse other users.
- Attempt to gain unauthorised access to our systems or another user's account.
- Use automated tools, bots, or scripts to interact with the service without our written consent.
- Reproduce, distribute, or resell any content from Vernac without our permission.
We may remove content or suspend accounts that violate these rules, at our sole discretion and without prior notice.
6. User-generated content
When you submit content through Vernac — including sentences in practice mode or responses in the Word of the Day community — you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and moderate that content within the Vernac service. You retain ownership of your content.
You are responsible for the content you submit. Do not submit content that is offensive, illegal, or violates the rights of others. We may moderate, remove, or decline to display community content at our discretion.
7. Intellectual property
All content in Vernac — including the app itself, word bank content, AI-generated example sentences, audio recordings, design, and branding — is owned by or licensed to us and is protected by intellectual property law. You may not copy, reproduce, or distribute it without our permission.
"Vernac" and the Vernac "V" mark are trademarks of Pureheart Moluno. You may not use them without our written consent.
8. AI-generated content
Example sentences, context hooks, story content, and practice feedback within Vernac may be generated by AI language models. While we review and curate AI output, we do not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated content. AI content reflects the training data and prompts used at the time of generation and may occasionally contain errors or outdated information.
AI-generated feedback on your sentences (e.g. in "use it in a sentence" mode) is for learning purposes only and should not be relied upon as authoritative linguistic guidance.
9. Device identification
Vernac identifies your device using app-generated IDs (created by the app at install time) and service-generated IDs (assigned by third-party services such as Expo and PostHog to support analytics and push notifications). These identifiers are pseudonymous and are used solely to operate and improve the service.
We do not collect hardware identifiers from your device. This means we do not access or store your device's IMEI number, MAC address, serial number, or any other identifier that is permanently tied to the physical hardware.
10. Third-party services
Vernac integrates with third-party services including Apple App Store, Google Play, RevenueCat, Anthropic, OpenAI, ElevenLabs, PostHog, Sentry, and Cloudflare. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services.
Links or references to external content (e.g. in blog posts or community features) are provided for convenience. We do not endorse and are not responsible for external content.
11. Disclaimers
Vernac is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses.
Vocabulary content in Vernac is intended for general learning purposes. It is not a substitute for professional editorial, linguistic, or academic guidance.
12. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use Vernac, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of Vernac will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £10 / $10.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless Pureheart Moluno from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of Vernac, your violation of these Terms, or your violation of any third party's rights.
14. Termination
You may stop using Vernac and delete your account at any time from Settings → Account → Delete account. We may terminate or suspend your access if you violate these Terms. Upon termination, your right to use Vernac ceases immediately. Sections 7, 11, 12, 13, and 15 survive termination.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any dispute arising from these Terms or your use of Vernac that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
Before bringing a formal claim, you agree to contact us at contact@pmoluno.com and give us 30 days to resolve the issue informally.
